1. Acceptance of Terms
This Terms of Service (the "Terms") describes the rights and responsibilities that apply to your use of Physician Pivot's websites (collectively, the "Service"), each owned and operated by Framework Solutions LLC ("Physician Pivot", "we", "our" or "us").
By accessing or using the Service in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Service.
We reserve the right to modify these Terms at any time. When we make material changes, we will update the effective date above and, where appropriate, notify you by email or through a prominent notice on the Service. Your continued use of the Service after any such modifications constitutes your acceptance of the revised Terms.
2. About the Service
Physician Pivot is a niche job board and professional community platform designed exclusively for physicians holding MD or DO degrees who are exploring non-clinical career opportunities - whether as a full-time transition or a supplemental income stream. The Service aggregates and publishes non-clinical job opportunities across categories including, but not limited to, medical affairs, pharmaceutical and biotech, consulting, utilization review, health technology, medical education, research, writing and media, health policy, and executive leadership roles.
Important: Many job listings on the Service are sourced from third-party career pages, job boards, and employer websites through automated data collection. These listings may be supplemented or enriched using artificial intelligence to improve categorization, metadata accuracy, and searchability. While we take reasonable steps to ensure quality, we cannot guarantee that all listing information is complete, current, or error-free. You should always verify job details directly with the hiring company before applying.
3. Eligibility
To use the Service, you must meet all of the following requirements:
You must be at least 18 years of age.
You must be a licensed or formerly licensed physician holding an MD or DO degree, a medical student, or a resident physician. Employer accounts are exempt from this credential requirement.
You must reside in the United States or its territories.
You must provide accurate, truthful, and current information when creating an account or submitting any data through the Service. You agree to update your information promptly if it changes.
You may maintain only one personal account. Creating multiple accounts for the same individual is prohibited and may result in suspension or termination of all associated accounts.
If you are registering an account on behalf of a company or organization (an "Employer Account"), you represent and warrant that you are duly authorized to bind that entity to these Terms.
4. Account Security
You are responsible for maintaining the confidentiality and security of your account credentials, including your password, and for all activity that occurs under your account.
You must not share your account credentials with any third party. If you become aware of or reasonably suspect any unauthorized access to or use of your account, you must notify us immediately at legal@physicianpivot.com. We will not be liable for any loss or damage arising from your failure to comply with these account security obligations.
5. User Types
5.1 Job Seekers
As a job seeker, you may create and maintain a personal profile, search and browse job listings, save jobs for later review, receive personalized job alerts, and track your application activity. You have control over the visibility of your profile and may update your preferences at any time.
When submitting applications, you represent that all information provided is accurate and truthful. Misrepresentation may result in the withdrawal of any offer made on the basis of your application and may lead to suspension or termination of your account.
5.2 Employers
As an employer, you may create and manage a company profile, post job listings, review applications received through the Service, and access analytics relating to your listings. We may require domain verification or other forms of identity confirmation. Employers are solely responsible for ensuring that job postings and hiring practices comply with all applicable federal and state employment laws, including anti-discrimination and equal opportunity requirements.
6. Content Standards
6.1 Employer Obligations
Employers posting job listings must ensure that:
All job postings represent genuine, currently available positions.
Job descriptions are accurate, complete, and not misleading regarding the role, responsibilities, required qualifications, compensation, and working arrangements.
Salary and compensation information, where provided, is truthful and reflects the actual compensation offered.
Company profile information is current and accurate.
6.2 Prohibited Content
The following types of content are strictly prohibited on the Service:
Fraudulent, fictitious, or materially misleading job postings.
Content that is discriminatory on the basis of any characteristic protected by applicable federal or state law, including race, sex, age, disability, religion, national origin, or veteran status.
Content that promotes, facilitates, or relates to unlawful activities.
Listings for multi-level marketing, pyramid schemes, or similar structures.
Spam, unsolicited commercial messages, or bulk communications unrelated to legitimate job opportunities.
Content that infringes upon the intellectual property, privacy, or other legal rights of any third party.
Content containing malware, viruses, or any other harmful code or technology.
Keyword stuffing or other manipulative techniques designed to artificially inflate search results.
6.3 Content Moderation
We reserve the right, but are not obligated, to review, edit, refuse, or remove any content submitted to the Service at our sole discretion and without prior notice. Repeated or serious violations may result in immediate suspension or permanent termination of your account.
7. Job Data and Third-Party Listing Disclosure
Physician Pivot operates primarily as an aggregation platform. A significant portion of listings are sourced automatically from publicly accessible third-party websites, including employer career pages, general job boards, and professional association boards. These listings are normalized, deduplicated, and enriched with physician-specific metadata through automated and AI-assisted processing.
Sourced listings display attribution indicating the original source (e.g., "via LinkedIn" or "via company site") and include a link to the original posting. Employers whose listings are sourced in this manner may contact us to request corrections or removal at legal@physicianpivot.com.
Sourced listings that are unclaimed by the employer are subject to automatic expiration after 60 days or upon detection that the original source URL is no longer active, whichever occurs first.
8. Applications and Data Sharing
When you submit a job application through the Service, the information you provide - including your name, contact information, cover letter, and any uploaded documents such as your CV or resume - will be shared with the employer associated with that listing.
Once your application data has been shared with an employer, the employer becomes independently responsible for how they use, store, and process your personal data. We are not responsible for and have no control over the data handling practices of employers after your application data has been shared.

9. Billing and Payments
9.1 Job Seeker Access
Core job search and browsing features of the Service are provided to job seekers free of charge. Certain premium features may be introduced in future versions of the Service and will be clearly disclosed at the time of any fee.
9.2 Employer Paid Listings
Employers may purchase paid listing tiers, which provide premium placement, enhanced visibility, and analytics. Current pricing is displayed on our pricing page. All payments are processed through Stripe, Inc. By completing a purchase, you agree to Stripe's terms of service. We do not store your full payment card information.
9.3 Refunds
Refund requests for employer listing fees must be submitted within 3 days of purchase and before the listing has received any meaningful impressions or clicks. After this period, refunds are issued at our sole discretion. To request a refund, contact us at legal@physicianpivot.com.
10. Intellectual Property
10.1 Our Property
The Service, including its name, logo, visual design, user interface, underlying source code, software, databases, and all proprietary materials, is owned by or licensed to Physician Pivot and is protected by applicable United States intellectual property laws. All rights not expressly granted in these Terms are reserved.
10.2 Your Content
You retain ownership of all content you submit, upload, or otherwise provide to the Service ("User Content"), including job applications, profile information, company descriptions, and job listings. By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, distribute, and process your User Content as reasonably necessary to operate and improve the Service.
This license terminates when you delete your User Content or close your account, except where your content has been shared with third parties or is required for legal compliance or archival purposes as described in our Privacy Policy.
11. Prohibited Uses
You agree not to engage in any of the following activities in connection with the Service:
Scraping, crawling, harvesting, or using any automated means to access, collect, or extract data from the Service without our prior written permission.
Attempting to gain unauthorized access to any portion of the Service, other user accounts, or systems connected to the Service.
Circumventing, disabling, or interfering with any security-related features of the Service.
Sending unsolicited messages, spam, or bulk communications to other users.
Creating fake, fraudulent, or misleading accounts, profiles, or identities.
Impersonating any person, company, or entity, or misrepresenting your credentials, specialty, or licensure status.
Using the Service for any purpose that is unlawful, fraudulent, or harmful.
Reverse engineering, decompiling, or otherwise attempting to derive the source code of any software used in the Service.
Using the Service in any manner that could damage, disable, overburden, or impair the Service or interfere with any other party's use and enjoyment of the Service.
12. No Professional or Medical Career Advice
The information and content available on the Service - including job listings, salary data, employer descriptions, resource guides, and any community content - is provided for informational purposes only. Nothing on the Service constitutes legal, financial, medical career, or professional advice.
You should independently verify any information before relying on it in connection with career, employment, or financial decisions. We expressly disclaim any responsibility for decisions made in reliance on information obtained through the Service.
13. Third-Party Links and External Sites
The Service contains links to external websites, including employer career pages and external application URLs. These links are provided for convenience only. We do not control, endorse, or assume responsibility for the content, privacy policies, or practices of any third-party website.
When you follow a link from the Service to an external website, including when clicking "Apply" on a listing that directs you to an employer's site, you leave the Service and are subject to the terms and privacy policies of that external site. We are not responsible for any loss, damage, or harm arising from your use of or reliance on any external website.
14. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE MAKE NO REPRESENTATIONS OR WARRANTIES THAT: (A) THE SERVICE WILL RESULT IN ANY PARTICULAR EMPLOYMENT OUTCOME, INCLUDING JOB PLACEMENT OR HIRING; (B) JOB POSTINGS ARE ACCURATE, COMPLETE, OR CURRENT; (C) ANY COMPANY LISTED GENUINELY OFFERS THE ROLES OR ARRANGEMENTS DESCRIBED; OR (D) THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
WE ARE NOT A PARTY TO ANY EMPLOYMENT RELATIONSHIP, CONTRACT, OR AGREEMENT BETWEEN JOB SEEKERS AND EMPLOYERS. ANY HIRING DECISIONS, EMPLOYMENT TERMS, OR WORKING ARRANGEMENTS ARE SOLELY BETWEEN THE EMPLOYER AND THE JOB SEEKER.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF PHYSICIAN PIVOT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNTS PAID BY YOU TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Nothing in these Terms excludes or limits our liability for fraud or fraudulent misrepresentation, or any matter for which exclusion of liability would be unlawful under applicable law.
16. Indemnification
You agree to defend, indemnify, and hold harmless Physician Pivot and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:
Your use or misuse of the Service.
Any content you submit, post, or transmit through the Service.
Your violation of these Terms or any applicable law, regulation, or third-party rights.
Any misrepresentation of your credentials, specialty, or licensure status.
Any dispute between you and a third party (including employers and other job seekers) arising from your use of the Service.
17. Termination
17.1 Termination by You
You may close your account at any time by using the account deletion feature in your account settings or by contacting us at legal@physicianpivot.com. Upon account closure, your profile and associated data will be handled in accordance with our Privacy Policy.
17.2 Termination by Us
We may suspend or terminate your access to the Service, in whole or in part, without prior notice if you violate these Terms or engage in conduct we reasonably determine to be harmful to the Service, other users, or our legitimate business interests. Serious or repeated violations may result in immediate and permanent termination.
We may also terminate inactive accounts that have not been accessed for two (2) or more years, with at least 30 days' advance notice sent to the email address on file.
17.3 Effect of Termination
Termination does not affect any rights or obligations that accrued prior to termination. Any provisions of these Terms that by their nature should survive termination shall continue in full force and effect, including intellectual property provisions, limitation of liability, indemnification, and dispute resolution.
18. Governing Law and Dispute Resolution
These Terms and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.
Before initiating any formal legal proceedings, you agree to first contact us at legal@physicianpivot.com to attempt to resolve the matter informally. We will endeavor to respond to any dispute or complaint within 30 days of receipt.
Any legal action or proceeding arising out of or related to these Terms or the Service shall be brought exclusively in the state or federal courts located in Delaware, and you hereby consent to the personal jurisdiction of such courts.
TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AND THE COMPANY EACH WAIVE ANY RIGHT TO A JURY TRIAL IN ANY ACTION ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE.
19. Class Action Waiver
TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE TO RESOLVE ANY DISPUTES WITH US ON AN INDIVIDUAL BASIS AND WAIVE ANY RIGHT TO PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING.
20. General Provisions
20.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Company with respect to the use of the Service and supersede all prior communications, proposals, and agreements, whether electronic, oral, or written.
20.2 Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.
20.3 Waiver
Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of the Company.
20.4 Assignment
We may assign or transfer our rights and obligations under these Terms at any time, including in connection with a merger, acquisition, or sale of assets. You may not assign or transfer your rights under these Terms without our prior written consent.
20.5 Force Majeure
We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, internet disruptions, or governmental actions.
